SIGNED AGREEMENT ON COOPERATION REGARDING THE APPLICATION OF MEDIATION IN THE FIELD OF INTELLECTUAL PROPERTY

The Ministry of Justice, the Commercial Court of Appeals in Belgrade, the Commercial Court in Belgrade, the Court of Appeals in Belgrade, the High Court in Belgrade and the Intellectual Property Office signed an Agreement on Cooperation in the Application of Intellectual Property Mediation on May 28, 2020.

Given the emergency epidemiological situation caused by the coronavirus, a special ceremony in the presence of the media and all interested parties will be subsequently organized to present and promote the Agreement when circumstances allow.

The Instruction for Improving the Application of Mediation in the Republic of Serbia of June 28, 2017 emphasizes that the court is obliged to provide all necessary information in order to fully inform the parties about the possibility of mediation, and to encourage active cooperation of the court with external partners based on concluded cooperation protocols. . In accordance with the above, the Ministry of Justice and the courts in which the concentration of competencies in the field of intellectual property rights was performed, on the one hand, and the Intellectual Property Office, whose competence is professional and administrative affairs related to intellectual property rights, on the other hand , recognized the importance of mutual cooperation in this specific area and the need to improve the conditions for the development of mediation, in order to ensure better and more effective protection of the rights of the parties. The Ministry of Justice will support the implementation of the Agreement and the improvement of cooperation, and together with other signatories will continuously undertake activities in order to inform the general public about the possibilities and advantages of mediation. The Ministry, the courts and the Office are supported by the European Union project "EU with Justice" in the implementation of this activity.

It is planned that the signatories of the Agreement achieve the goals of signing the Agreement, inter alia, by continuously informing parties, lawyers and other relevant parties about the possibilities and benefits of mediation in the field of intellectual property, organizing joint activities such as conferences, seminars, conferences, professional programs, open days and info-sessions in the field of mediation of disputes related to intellectual property rights, and the establishment of a continuous dialogue and mutual exchange of information regarding the possibility of resolving disputes in the field of intellectual property through mediation.

Given the current epidemiological situation, signatories will consider ways in which they can take action to promote mediation and other relevant activities through social media, organizations' websites and other appropriate means.

As the first result of the cooperation, the Intellectual Property Office opened a section on mediation on its website, as well as a list of mediators with specific knowledge in the field of intellectual property rights, which is available to courts and all other interested parties on the Intellectual Property Office website.
